TERMS AND CONDITIONS – GO FISHING IRELAND GUIDED FISHING SERVICES

These Terms and Conditions apply to guided fishing trips and related services provided by CHRISTOPHER BARRY, of GO FISHING IRELAND, MACETOWN, NAVAN, CO. MEATH, C15P0A9, Ireland (“we”, “us”, “our” or “the Guide”).

By making a booking, the person making the booking (“the Customer”) agrees to these Terms and Conditions on behalf of themselves and, where applicable, confirms that the other members of their party have been made aware of these Terms and Conditions.

1. Bookings

A booking is confirmed when:

  • we confirm acceptance of the booking; and
  • the required booking deposit or full payment has been received.

Bookings are subject to availability.

The Customer is responsible for ensuring that the information supplied when making the booking is accurate, including the number of participants and any relevant information concerning the participants that may reasonably affect the safe provision of the trip.

2. Prices and Payment

The price of the fishing trip will be the price agreed at the time of booking.

A booking deposit is required to secure the booking. The amount will be specified at the time of booking.

Unless otherwise agreed, the remaining balance must be paid in advance or on the day of the fishing trip/lesson.

The booking deposit is applied towards the total cost of the trip.

3. Customer Cancellation

Because guided fishing trips are reserved for a specific date and capacity is limited, cancellations can result in the Guide being unable to rebook the date.

Accordingly, the booking deposit is non-refundable where the Customer cancels the booking, except where required by applicable law.

If the Customer cancels:

More than 7 days before the trip:
The booking deposit will not be refunded. However, the Customer may request to reschedule the trip once, subject to availability. The original booking deposit will then count towards the rescheduled trip.

Less than 7 days before the trip:
Payments made are non-refundable. At our discretion, we may allow the booking to be transferred to another available date.

Within 48 hours of the trip or failure to attend:
The full trip price is payable and no refund will be provided.

Where we permit a booking to be rescheduled, the replacement trip must normally take place within 12 months of the original booking date and is subject to availability.

A booking that has already been rescheduled by the customer may not normally be rescheduled a second time.

These cancellation provisions do not affect any statutory rights the Customer may have.

4. Weather Conditions

Fishing is an outdoor activity and is affected by weather and water conditions.

Rain, cold weather, wind or poor fishing conditions do not automatically constitute grounds for cancellation or a refund.

The Guide will determine whether conditions are reasonably suitable and safe for the trip, taking account of matters including weather forecasts, wind, water conditions and the location being fished.

Customers should arrive with clothing and footwear suitable for the forecast conditions.

If conditions are safe to fish but the Customer chooses not to participate because of the weather, this will be treated as a Customer cancellation under Clause 3.

5. Cancellation by the Guide

Safety takes priority over completing a trip.

We may cancel, postpone, shorten or change the location of a trip where reasonably necessary because of:

  • unsafe weather or water conditions;
  • severe weather warnings;
  • equipment or boat failure;
  • illness or incapacity of the Guide;
  • access restrictions;
  • circumstances affecting the safe operation of the trip; or
  • other circumstances outside our reasonable control.

Where reasonably possible, we will first attempt to offer an alternative location, time or date.

If we cancel the trip and cannot provide a reasonable alternative date acceptable to the Customer, payments made for the affected trip will be refunded.

We will not be responsible for consequential expenses incurred by the Customer, such as accommodation, flights, transport or other travel expenses, except to the extent that liability cannot lawfully be excluded.

Customers travelling specifically for a fishing trip are therefore advised to obtain appropriate travel insurance.

6. Changes to Fishing Location

The fishing location stated when booking may need to be changed because of weather, water levels, fishing conditions, safety considerations, access restrictions or other operational reasons.

The Guide may select an alternative fishing location where reasonably necessary.

A reasonable change of fishing location does not, by itself, entitle the Customer to cancel the booking or receive a refund, provided that the Guide is still able to provide a substantially equivalent guided fishing service.

7. Fishing Results

Fishing involves natural and unpredictable conditions.

We cannot guarantee:

  • that fish will be caught;
  • the number of fish caught;
  • the species or size of fish caught; or
  • particular fishing conditions.

The absence of fish or poor fishing conditions does not entitle the Customer to a refund where the guided service has otherwise been provided as agreed.

8. Safety and Customer Responsibilities

Fishing and boating are outdoor activities involving inherent risks, including slips and falls, hooks and fishing equipment, uneven terrain, changing weather, water, boats and other natural hazards.

Customers must:

  • follow reasonable safety instructions given by the Guide;
  • use any safety equipment provided or required;
  • behave responsibly;
  • take reasonable care for their own safety and the safety of others;
  • inform the Guide of any matter that could reasonably affect their ability to participate safely;
  • not deliberately damage boats, fishing equipment or other property; and
  • comply with applicable fishing, conservation and environmental rules.

Where a lifejacket or personal flotation device is required, it must be worn as instructed by the Guide.

9. Right to Refuse or Terminate Participation

The Guide may refuse to allow a person to participate, or may terminate their participation during a trip, where the Guide reasonably considers that the person:

  • is intoxicated or under the influence of drugs;
  • is behaving dangerously, aggressively or irresponsibly;
  • refuses to follow reasonable safety instructions;
  • presents a material risk to themselves or another person; or
  • is otherwise unable to participate safely.

Where participation is refused or terminated because of the Customer’s conduct, no refund will normally be provided.

10. Alcohol and Drugs

Customers must not participate while impaired by alcohol or drugs.

The consumption of alcohol while aboard a boat may be prohibited by the Guide.

The Guide’s decision regarding whether a participant is fit to participate safely is final for the purposes of deciding whether the trip can safely proceed.

11. Children and Young Persons

Participants under the age of 18 must be accompanied by a parent, legal guardian or other responsible adult unless expressly agreed otherwise in advance.

The accompanying adult remains responsible for supervising the young person, subject to the Guide’s responsibility for safely providing the guided service.

The Guide may specify a minimum age for particular fishing trips or locations where reasonably necessary for safety reasons.

12. Fishing Licences and Permits

Customers must comply with all applicable Irish fishing laws, regulations, by-laws, permit requirements, conservation measures and local fishery rules.

The booking confirmation will state whether required licences or permits are:

  • included in the trip price;
  • arranged separately by the Guide; or
  • the Customer’s responsibility.

Where the Customer is responsible for obtaining a licence or permit, failure to obtain the required licence or permit does not entitle the Customer to a refund.

13. Equipment

The booking information will state what fishing equipment, tackle and safety equipment are included.

Customers are expected to take reasonable care of equipment supplied to them.

Customers may be charged the reasonable cost of repairing or replacing equipment where the damage or loss results from deliberate, reckless or negligent conduct by the Customer, excluding ordinary wear and tear.

Customers using their own fishing equipment do so at their own risk.

14. Personal Property

Customers are responsible for their own personal possessions.

We recommend that valuable items, electronic equipment and other items susceptible to water damage are appropriately protected.

To the extent permitted by law, we are not responsible for loss of or damage to personal property unless caused by our negligence or breach of our legal obligations.

15. Boats and Water-Based Trips

Where a trip involves the use of a boat:

  • all passengers must comply with the Guide’s instructions;
  • required personal flotation devices must be worn;
  • passengers must remain seated or positioned as instructed while the boat is underway;
  • passengers must not interfere with the operation of the boat or safety equipment; and
  • the Guide may return to shore or terminate the trip where reasonably necessary for safety.

The Guide retains responsibility for decisions concerning the safe operation of the vessel.

16. Assumption of Ordinary Risks

Customers acknowledge that fishing and boating are outdoor activities and involve risks that cannot be entirely eliminated even when reasonable care is taken.

Acceptance of the ordinary risks associated with fishing does not exclude or restrict any liability which cannot lawfully be excluded, including liability arising from the Guide’s own acts or omissions where applicable.

Nothing in these Terms and Conditions limits the Customer’s statutory rights.

17. Liability

We will provide the guided fishing service with the level of skill, care and diligence required by applicable Irish law.

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury arising from our acts or omissions.

Subject to the above and to the Customer’s statutory rights, we will not be responsible for losses resulting from:

  • the Customer’s failure to follow reasonable instructions;
  • the Customer’s own negligent, reckless or deliberate actions;
  • risks inherent in fishing which could not reasonably have been avoided by the Guide exercising appropriate care;
  • circumstances outside our reasonable control; or
  • loss or damage which was not reasonably foreseeable when the booking was made.

Nothing in these Terms and Conditions is intended to exclude or restrict any right or remedy available to a consumer under Irish law.

18. Force Majeure and Events Outside Our Control

We will not be responsible for failure to provide a trip where this results from circumstances outside our reasonable control, including extreme weather, flooding, storms, unsafe water conditions, closure of fisheries, government restrictions, natural disasters or similar events.

Where such circumstances prevent the booked trip from proceeding, we will normally offer an alternative date.

If we cannot provide the booked service within a reasonable period, the Customer’s statutory rights, including any applicable right to a refund, will remain unaffected.

19. Photography

Photographs or videos may occasionally be taken during fishing trips.

We will obtain the Customer’s permission before using an identifiable photograph or video of the Customer for advertising, social media or other promotional purposes.

Customers may tell the Guide at any time that they do not wish to be photographed or included in promotional material.

Separate rules apply to images of children, and appropriate consent will be obtained before identifiable images of children are used for promotional purposes.

20. Personal Data

Personal information supplied in connection with a booking will be processed in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

21. Complaints

If a Customer is dissatisfied with any aspect of the service, they should raise the matter with the Guide as soon as reasonably possible so that we have an opportunity to address the issue.

We will endeavour to respond to complaints within a reasonable period.

Nothing in this clause limits a Customer’s statutory rights or right to pursue an available legal remedy.

22. Consumer Rights

These Terms and Conditions do not affect any mandatory rights available to consumers under Irish law, including the Consumer Rights Act 2022.

Guided fishing trips booked for a particular date or period are leisure services supplied on a specific date or during a specific period. Where the statutory exemption applicable to such services applies, the normal statutory cancellation or cooling-off period applicable to certain distance or off-premises contracts does not apply.

The cancellation arrangements in Clause 3 therefore apply, subject always to the Customer’s mandatory statutory rights.

23. Gift Vouchers

Where gift vouchers are offered:

  • vouchers may be redeemed subject to availability;
  • a fishing date must be booked in advance;
  • vouchers cannot normally be exchanged for cash except where required by law; and

Once a particular fishing date has been booked using a voucher, the cancellation provisions in Clause 3 apply.

24. Entire Agreement

These Terms and Conditions, together with the booking confirmation and any specific written arrangements agreed between the parties, form the agreement relating to the booked fishing service.

If a particular term of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

25. Governing Law

These Terms and Conditions are governed by the laws of Ireland.

Nothing in this clause deprives a consumer of any mandatory protections or rights regarding jurisdiction available to them under applicable consumer law.
